What is foreclosure?
Foreclosure is an action by the bank to take back your property.
I was served with a foreclosure action. What happens next?
Once a process server hands you a copy of a Foreclosure action, you have twenty (20) days to answer. If you do not file an answer, you may not be able to defend against the foreclosure. If you have been served with a foreclosure action, you must call an attorney right away to protect your rights.
How can you defend my foreclosure?
The banks foreclosure lawyers must follow a specific procedure in order to obtain a judgment of foreclosure. This process can take several months. During this time, a foreclosure defense attorney can raise defenses to the banks action and allow you extra time to take action to save your home.
What is loan modification?
A loan modification adjusts the terms of an existing loan so that payments are more affordable level. A loan modifications may mean reducing the interest rate, extending the time for repaying the mortgage, and, in some cases, reducing the amount of the principal balance due on the underlying loan.
I am negotiating with the bank. Am I “safe” from having a foreclosure action filed against me?
NO. The bank may file a foreclosure action against you even if you are negotiating with them or in the loan modification process.
What is the difference between a foreclosure lawyer and a foreclosure assistance firm?
A foreclosure assistance firm cannot fight a foreclosure in court. A foreclosure assistance firm cannot tell you about your legal rights. Beware of “foreclosure consultants” and “loan modification consultants” who will take your money and do nothing while the bank takes your house.
Only a licensed foreclosure attorney can do these things for you. A foreclosure attorney can aggressively litigate your foreclosure case. A foreclosure attorney can also tell you the steps that will be taken to protect your home, suggest defenses and help you negotiate with the bank.
What if I can’t afford to pay a foreclosure lawyer?
Hiring a foreclosure lawyer is more affordable than you may think.
Once the foreclosure process starts, the foreclosure bank stops accepting mortgage payments and the foreclosure bank pays any delinquent real estate taxes and the insurance. During foreclosure and throughout the modification, the bank pays these expenses while you continue to live in your home. Hiring a foreclosure attorney representation to help fight foreclosure and possible loan modification is extremely small in comparison to the typical home ownership expenses which you will not be paying during this time. Its really a no-brainer to fight foreclosure by engaging a qualified foreclosure lawyer.
